Doug Greene, Leader of the Firm’s Securities and Governance Litigation team; Counsel Albert Lin; and Associates Ivory Bishop and Genevieve York-Erwin authored an article published by the Washington Legal Foundation on April 2, 2020. The article, “Omnicare, Five Years Later: Strategies for Securities Defense Lawyers’ More Effective Use of the Decision,” discusses how the U.S. Supreme Court’s landmark decision in Omnicare, Inc. v Laborers Dist. Council Const. Indus. Pension Fund established clear standards for evaluating statements of opinion, such as earnings projections and other forward-looking statements, accounting estimates, Sarbanes-Oxley certifications, strength of current performance, and more.

The authors review the application of the Omnicare decision since it was issued in 2015, and suggest strategies for making use of Omnicare’s standards when defending securities class actions.

Greene authored a U.S. Supreme Court amicus brief on behalf of Washington Legal Foundation in the Omnicare case.
