Hittinger, Duffy Article in Legal Intelligencer Examines FTC Opposition to West Virginia Hospital Merger

Partner Carl Hittinger and Counsel Jeffry Duffy have authored an article published December 7, 2015, in The Legal Intelligencer. The article, “FTC Brushes Aside AG, Regulators to Attack Local Hospital Merger,” summarizes the opposition of the Federal Trade Commission (FTC) to a proposed merger of two West Virginia hospitals, even though the state’s attorney general and other regulators support the merger. Hittinger and Duffy explain that the matter: “…presents an interesting spectacle of the FTC, in the single-minded pursuit of its competitive mission, brushing aside state government concerns perceived in its own state about both unemployment and potentially destabilizing overcapacity in institutional health care facilities.”
