Partners Carl Hittinger, Danyll Foix and Jeffry Duffy and Associates Mitchell Oates and Tyson Herrold authored an article published in Global Competition Review’s The Antitrust Review of the Americas 2019. The article, “United States: Private Antitrust Litigation,” is a comprehensive review of the current landscape of U.S. government litigation against makers of branded and generic pharmaceutical products over settlements of patent infringement actions under the Hatch-Waxman Act. In particular, the authors discuss recent litigation over so-called “reverse payment” settlements, and the latest developments in the Federal Trade Commission’s challenges to such settlements as anticompetitive.
