Jonathan New, Victoria Stork Article Takes a Look at Justice Department Effort to Curb ‘Piling On' of Corporate Penalties

Partner Jonathan New and Associate Victoria Stork authored an article published in the September 2018 issue of Business Crimes Bulletin. The article, “Coordination or Duplication? DOJ Adopts New Policy to Prevent ‘Piling On’ of Corporate Penalties,” discusses a recent Department of Justice (DOJ) policy intended to prevent multiple and often duplicative penalties in white collar criminal and civil enforcement actions.

New and Stork analyze the main features of the policy and note that much remains to be determined regarding its use, in the United States and in international investigations. They conclude: “…uncertainties will remain until other law enforcement agencies in the U.S. and abroad clarify their respective positions on duplicative financial penalties.”
