Counsel Kyle Gee authored an article that appeared in the September/October 2020 issue of Probate Law Journal of Ohio, published by the Ohio State Bar Association. The article, “Controversial Ohio H.B. 692: Pushed Into The Swirling Waters Of “Physical Presence,” “Conscious Presence,” and “Electronic Presence,” discusses a state bill that would permit the signing of wills, financial powers of attorney, advance health care directives, and TOD designation affidavits entirely online without anyone being in the physical presence of the signer. Gee summarizes the bill’s origins and key provisions and notes that both the Ohio State Bar Association and the Ohio Association of Probate Judges have formally opposed this bill.
