Skapof, Klidonas Analyze Recent Lien-Stripping Decision for The Banking Law Journal

Counsel Marc Skapof and Associate George Klidonas authored an article published in the January 2016 issue of The Banking Law Journal. In the article, “Secured Creditors Beware: Liens May Be Extinguished Under a Chapter 11 Plan,” Skapof and Klidonas explain a Second Circuit decision holding that where a plan “deals”’ with a secured creditor’s lien and the secured creditor “participates” in the bankruptcy case, the confirmation of a plan extinguishing the lien can be valid. They conclude that “secured creditors should be mindful of the consequences of abstaining from exercising their rights.”
