Tax Code Section 1031 for like kind exchanges of property is a valuable tool for deferring gain in applicable transactions, but the devil is in the details. In an area of the law where often the form of a transaction is elevated above the substance, misunderstanding or simple errors in the 1031 exchange process could result in the transaction being ineligible to reap the benefits of the Section 1031 exchange under the tax code.
