Please join us for a timely and practical CLE program on how sanctions, export controls, force majeure, and related performance defenses are reshaping cross-border contracting and disputes.

As regulatory regimes shift and global business conditions become more volatile, companies and their counsel face increasingly complex questions:

How should sanctions and export-control risks be addressed in commercial agreements?

When does legal compliance excuse performance — and when might it create exposure for breach?

What do force majeure, hardship, frustration and change-in-circumstances clauses actually accomplish when invoked?

How do these arguments fare when the dispute proceeds to international arbitration?

During this program, our panelists will examine these issues from both the front end and the back end of the deal. The discussion will address practical drafting considerations for sanctions and export-control clauses, compare how common-law and civil-law regimes treat force majeure and related doctrines, and explore how these defenses are tested when disputes land in international arbitration. The panel will also discuss what arbitral tribunals tend to reward or reject, and how AAA-ICDR procedure can shape the outcome.

Artificial intelligence (AI) is rapidly transforming how legal professionals draft, analyze, and communicate – but recent federal court decisions make clear that AI is not a lawyer, and information shared with AI tools may not be protected by attorney-client privilege.

This webinar will explore the legal and practical implications of using generative AI in litigation and advisory contexts, with a focus on emerging case law holding that AI-generated materials and communications with AI platforms are not privileged. We will also examine how courts are approaching AI use in filings, the risks of inadvertent disclosure, and what this means for legal strategy and compliance.

What we’ll cover:

Introduction: What is AI? Applications, capabilities, and limitations (5 minutes)

AI in the Courtroom: Judicial scrutiny of AI-assisted filings and advocacy (15 minutes)

Privilege at Risk: Why AI communications may not be protected & key recent rulings (20 minutes)

Regulatory & Ethical Landscape: Emerging guidance, enforcement trends, and professional responsibility (20 minutes)

Risk Mitigation: Policies, safeguards, and best practices (20 minutes)

The business of sports is increasingly powered by personal data. Teams, leagues, and a growing network of technology providers, media companies, and commercial partners are collecting and using data across the sports ecosystem, including professional and amateur athlete tracking, in stadium and digital fan engagement, and sports gaming. These data streams often intersect, are shared across multiple platforms and partners, and can be difficult to map, control, and disclose accurately. As the use of analytics, AI, and vendor driven technologies expands, regulators are signaling increased scrutiny around sensitive data, profiling, and data commercialization practices, particularly where multiple data sets are combined or reused.

This webinar will explore practical approaches to identifying and managing privacy risks across complex, interconnected data streams, using sports data as a lens for challenges that apply to many data driven companies, including:

How athlete data, including biometrics and performance tracking, is regulated and where heightened obligations may apply

Identifying and managing data collection across in-stadium and digital fan experiences

Understanding how vendor platforms, analytics tools, and AI can expand data use and create additional compliance concerns

Where data sharing and monetization practices, including sponsorships and partnerships, can trigger risk
