Farah Bhatti authored a case study for Law360.com regarding the trademark case Christian Louboutin SA v. Yves Saint Laurent America Holding Inc., in which the U.S. Court of Appeals for the Second Circuit decided that single color trademarks are registerable, protectable, and enforceable in the fashion industry. Bhatti addresses other instances in which colors have been trademarked in the fashion industry, particularly through acquiring secondary meaning—the instance when the color itself serves as an indicator of the source of the product.
