Partner <a href="https://www.bakerlaw.com/JasonFHoffman">Jason F. Hoffman</a> authored an article published Sept. 27, 2018, by Intellectual Property Magazine. The article, “The Road Rarely Taken by Patent Applicants,” examines the matter of Gilbert P. Hyatt v. Andrei Iancu and explains why patent applicants should consider filing Section 145 actions in district court to appeal adverse Patent Trial and Appeal Board (PTAB) decisions rather than going directly to the Federal Circuit. Hoffman writes: “A Section 145 action allows new evidence to be presented, gives a new trier of fact more time to consider that new evidence and removes the deference that would be otherwise owed to the determinations of the PTAB.”  <a href="https://www.intellectualpropertymagazine.com/legal_updates/gilbert-p-hyatt-v-andrei-iancu-131873.htm" target="_blank" rel="noopener">Read the article (subscription required)</a>.
