Cleveland Partner Ned Searby co-authored an article in The Global Business Law Review, Vol. 3, Issue 1, in fall 2012, entitled, "Closing the Gaps in Global Anti-Bribery Enforcement." The article, written with Erin Murdock-Park, examines the impact of the Foreign Corrupt Practices Act on United States multinational corporations and the ways in which its increased enforcement could further the original goal of promoting open competition on the merits. In the article, Searby and Murdock-Park look at whether increased U.S. enforcement of the FCPA damages competition based on price, quality, and service in two ways: "(1) U.S. companies have been disadvantaged in competing against foreign counterparts who face no credible threat of prosecution and (2) the intense focus on the bribery of foreign public officials has diverted compliance efforts from other forms of bribery that pose a comparable threat to competition."
