Overview

Jim Moore has practiced in the area of product and premises liability for chemical companies throughout his entire career, and also performs product work for pharmaceutical and medical device companies. Jim has particular experience in pesticide product liability cases. As an effective trial lawyer, Jim uses his ability to relate to juries to advocate for his clients and obtain the best results possible. He puts his clients’ interests first, making him a trusted resource for those faced with product liability matters.

  • Represented the manufacturer of a pesticide that, although it did well in the market, did not prove to be as efficacious as anticipated. Defeated the class actions filed against the client in multiple states and handled the remainder of cases around the country to minimize liability.
  • Tried a plant explosion case against one of the top plaintiff lawyers in the country, who sought $10 million each for two plaintiffs. Won against one plaintiff in a jury trial and the other received a minimal award.
  • Won three trials for a major manufacturer of orthopedic products in particularly difficult cases. A product had broken in each case, and challenges were presented when the client did not allow criticism of the surgeons. Convinced juries and judges that the reasons for the products’ failures were not product defects or errors by surgeons.

  • Has won pesticide product liability cases involving crop damage and personal injuries on the preemption defense under the Federal Insecticide, Fungicide and Rodenticide Act (FIFRA). Won some of the first cases in the nation for pesticide manufacturers using the FIFRA defense, including a wrongful death case filed by the family of a young farmworker in Georgia alleged to have died from pesticide exposure.
  • Has won the dismissal of hundreds of plaintiffs in community ambient exposure cases. Represented a chemical company and received dismissals of 120 of the 150 plaintiffs claiming sulfuric acid exposure after the court granted motion for a Lone Pine order, requiring early medical reports from all plaintiffs, who were residents adjacent to a chemical plant in Texas.
  • Tried and won a phosgene exposure case before a jury in federal court in Galveston, Texas, adding to his track record in exposure cases involving medical causation.
