As a member of the Views from the Bench Advisory Board, Partner Don Workman is pleased to invite you to the American Bankruptcy Institute’s 2016 Views from the Bench on October 7, 2016. The Views from the Bench is celebrating its 27th anniversary. The meeting features bankruptcy judges and leading practitioners from across the country.
VFB 2016 will examine some of the groundbreaking issues that are likely to dominate your bankruptcy practice throughout 2017. Two great debates will be the centerpiece. Craig Goldblatt will debate with Judge Kevin Carey over structured dismissals, and the use of this device without being attentive to the absolute priority rule. Judge Robert Gerber (retired) will debate with William Weintraub on whether the asset sales under § 363 can lawfully be free and clear of successor liability and the GM case. Some of the key topics to be examined include the following:
- Control of the system by hedge funds: Safe harbor for LBOs?
- D&O litigation: Coverage issues, claims against lenders, in pari delicto
- Retail bankruptcies: Are lenders finding strategies to avoid the Code’s landlord protections?
- Ethics issues: Boomerang and Baker Botts: The aftermath for legal fees.
