Derek Bauer Comments on Fee Award in Pennsylvania Open Records Case

Partner Derek Bauer is quoted in an article published on Jan. 8, 2021, by The Legal Intelligencer. The article, “Winning Lawyer Calls Right-to-Know Fee Award a ‘Stark Warning’,” reports on the Pennsylvania Supreme Court decision affirming a $118,458 sanction to be paid by the state Department of Corrections to Uniontown Newspapers, Inc., for failing to make a good-faith effort to fulfill a public records request made by a reporter.

Bauer, who practices media law but was not involved in this case, told the publication, “Over the past 15 years you could probably count on one hand the number of courts anywhere in the country that imposed anything more than a hand slap on state agencies that played games with open records requestors. It is very encouraging to see both federal and state courts beginning to give open government cases bigger teeth in cases of apparent abuse.”
