Duffy, Shadi and Siebert Discuss Managing Harassment Claims and Conducting Lawful and Effective Investigations

Dennis Duffy, Sabrina Shadi and Melissa Siebert are presenting at the National Employment Law Institute’s “Employment Law Update” in Washington, D.C., on July 27-28, 2017, San Diego on July 13-14, 2017, and Chicago on July 20-21, 2017, respectively.

Each will present “Managing Harassment Claims and Conducting Lawful and Effective Investigations,” which covers recent judicial and EEOC developments including what constitutes severe and pervasive conduct, same-sex harassment, when and how to establish an affirmative defense, and actions employers should implement to reduce exposure to liability. The presentation also covers conducting internal investigations and the additional legal requirements (and higher stakes) in harassment/discrimination investigations, including selecting the right investigator, defining the scope, distinguishing between fact finding and findings of policy and law, balancing confidentiality and the duty to investigate, ensuring prompt thorough investigations, establishing and preserving privilege, investigating misconduct with criminal implications, and/or in the absence of a cooperative complainant.
