The article, “Patent Owner History of Abusive Suits Mandates New Fees Look,” reports on a Federal Circuit ruling that said a Florida federal court failed to properly consider a patent owner’s history of frivolous litigation when it denied a request for attorneys’ fees from the owner’s latest target.
“The Federal Circuit continues to disfavor patent holders who demonstrate a pattern of low settlement offers and who have no intention of testing the merits of their claims,” Hoffman told the publication.
