John Lewis Comments on Dismissal of Supreme Court Petition Involving Evidence of Class Status in Wage Case

Partner John Lewis is quoted in an article published May 6, 2019, by Bloomberg Law. The article, “SCOTUS Won’t Weigh Class Status Evidence in Wage Case,” discusses the U.S. Supreme Court’s dismissal of a petition for review in a wage case after the trial court gave preliminary approval to a settlement. One of the issues was whether evidence used to support a bid for class certification must be admissible in court.

Lewis told the publication that allowing inadmissible evidence for class certification doesn’t comport with the Supreme Court’s view on class action procedures from its 2011 ruling in Wal-Mart v. Dukes and other decisions. He said he hopes the justices will get another chance to consider the issue.
