Jonathan Forman Discusses Key Points from First New York Cybersecurity Regulation Enforcement Action

Partner Jonathan Forman is extensively quoted in an article published Aug. 12, 2020, by Cybersecurity Law Report. The article, “Six Compliance Lessons from NYDFS’ First Cybersecurity Regulation Enforcement Action,” discusses the New York Department of Financial Services’ (NYDFS) first enforcement action alleging violations of the Cybersecurity Regulation, filing charges against the country’s largest title insurer for a failure to safeguard non-public information.

Forman told the publication that after years of the agency reviewing cybersecurity event notices, bringing this case sends the message that “the department is transitioning into an enforcement posture.” He also noted “the allegations themselves provide guidance about the department’s expectations” and added that because many other regulators based their laws on New York’s regulation, “all the other regulators are surely going to watch how this case proceeds.”
