Law Journal Article Addresses BakerHostetler Team's Success in Securing Full Case Dismissal at U.S. District Court

In a March 6, 2023, article titled “Manhattan Federal Judge Dismisses Suit Against Artist Peter Max’s Court-Appointed Guardian,” New York Law Journal discussed the victory and the central role played by Partners Oren Warshavsky, Tatiana Markel and Michelle Usitalo in securing it.

The team represented Barbara H. Urbach Lissner, court-appointed guardian of pop and psychedelic artist Peter Max, against claims made by Max’s daughter that included misconduct, intentional infliction of emotional distress and violation of New York’s anti-SLAPP law that prohibits strategic lawsuits against public participation.

The BakerHostetler team moved to dismiss the complaint for lack of subject matter jurisdiction and for failure to state a claim, and the motion was granted by the U.S. District Court for the Southern District of New York on March 3, 2023.

Warshavsky told New York Law Journal that this decision shows the plaintiff’s “allegations for what they are, and hopefully puts an end, at least for the time being, to the unjustified, ongoing efforts against Ms. Lissner.”
