Mark Kadzielski Talks to Bloomberg about California Case Involving Hospital's Appeal of Citation

Partner Mark Kadzielski is quoted in an article published on Aug. 23, 2018, by Bloomberg Law. The article, “Sponge Left in Patient Spawns California Supreme Court Battle,” reports on a case under review by the California Supreme Court that raises procedural questions about the length of time a hospital has before it asks for a reconsideration of a state administrative action.

Kadzielski told Bloomberg, “The procedural facts as opposed to the substantive facts are a close enough call that the California Supreme Court just wants to use some clarification here whether or not an appeal like this, filed when it was filed, is appropriate to be considered, or whether the underlying court decision throwing it out on procedural merit was correct.”
