Thurlow told the publication that the policy could create long-term trouble for EPA and companies if it is misinterpreted or misapplied. “EPA’s new enforcement policy appears intended to provide reassurance to the regulated community but provides little or nothing in guaranteed relief from enforcement because the policy invokes EPA’s discretion,” he wrote in an email.
