Julian Perlman Article on MLB Antitrust Win Published in Sports Litigation Alert

The Dec. 2, 2022, issue of Sports Litigation Alert includes an article authored by Counsel Julian Perlman titled “Yer Out (For Now): MLB Dismissed from Antitrust Lawsuit Because of Historic Antitrust Exemption.”

Of the case, Nostalgic Partners, LLC et al. v. The Office of the Commissioner of Baseball, which pits four minor league baseball clubs against Major League Baseball (MLB), Perlman writes that the granting to MLB of its motion to dismiss was based on the league’s antitrust exemption. However, “while ultimately finding that the antitrust exemption shielded MLB from antitrust suits of this nature, the court noted that the plaintiffs had otherwise adequately established antitrust standing and pleaded an antitrust violation,” Perlman writes.
