David Rivkin, Andrew Grossman and Richard Raile Author Report on Elections Clause and Upcoming Supreme Court Case

News / December 2, 2022

On Dec. 1, 2022, The Heritage Foundation published a report by Partners David Rivkin, Andrew Grossman and Richard Raile titled “History and Consequences: Setting the Record Straight on the Elections Clause and Moore v. Harper.”

In Moore v. Harper, the U.S. Supreme Court will consider whether a state’s judiciary may “nullify” and replace election regulations established by that state’s legislature to govern federal elections.

The authors write, “Most voters believe reasonable regulation of elections is appropriate, which is why most legislatures enact reasonable election laws. When they do not, federal law is more than equal to the task of intervening.”
