Todd Lebowitz Comments on New York Uber Driver Classification Decision

Partner Todd Lebowitz is quoted in an article published by Bloomberg’s “Daily Labor Report” on July 24, 2018. The article, “Uber Drivers May City N.Y. Unemployment Case in Employee Status Bids,” discusses an ongoing misclassification lawsuit filed by Uber drivers over wages and overtime pay. The New York Unemployment Insurance Appeal Board ruled in favor of Uber drivers in this case, finding that the ride-hailing company was the claimants’ employer and the drivers were not independent contractors.

Lebowitz told Bloomberg that the lesson for businesses seeking to avoid being named employers is “the same as always: reduce control wherever you can. No matter what, it’s always reduce the amount of control you exert.”
