In its June 2022 issue, Pratt’s Energy Law Report featured an analysis by Partner Tom Donaho titled “Common ‘Knock-for-Knock’ Indemnity Agreements May Not Limit Exposure as Parties Intended, Fifth Circuit Court of Appeals Rules.” The piece explains that, as a result of a U.S. Court of Appeals decision in February 2022, oil and gas companies will need to review form contracts, preexisting agreements and liability policies to determine the extent of their indemnity exposure.
