Law360 Names BakerHostetler ‘Environmental Practice Group of the Year'

NEW YORK, Jan. 18, 2018 – BakerHostetler’s environmental team has been named a Law360 “Practice Group of the Year” for the importance, complexity and success of its work in prominent cases for clients facing high-stakes environmental matters.

The team was recognized for its ability to obtain successful outcomes in “bet the company” matters. Its in-depth experience with complex environmental regulations resulted in swift and favorable resolutions to environmental disputes.

In recent years, our environmental team has won several key victories on behalf of Big River Steel (BRS) in its long-standing battle with competitor Nucor Corp. Most recently, the team secured a decision from the U.S. Environmental Protection Agency (EPA) rejecting a petition objecting to BRS’s Title V permit. These victories have allowed BRS to obtain critical financing to begin construction and operation of a groundbreaking project that is Arkansas’ first “super project,” expected to provide 575 new jobs – in addition to 2,000 construction jobs – in an economically depressed area.

In another milestone, the team obtained victory in the two-and-a-half-year battle to overturn a Bureau of Land Management (BLM) rule governing hydraulic fracturing on federal and Indian land when the U.S. Court of Appeals for the Tenth Circuit dismissed appeals seeking to overturn earlier rulings in favor of our clients, the Independent Petroleum Association of America and Western Energy Alliance. The Tenth Circuit’s ruling affirmed the team’s arguments that the proper forum for the policy debate on hydraulic fracturing is the administrative rule-making process, not the federal courts.

Additional significant representation includes defending Mississippi Silicon’s $250 million silicon metal manufacturing facility in Northeast Mississippi, the first new facility of its kind to be built in the U.S. for many years, and a key economic development in Mississippi. And the team’s defense of Westmoreland Coal Co. in a case of first of impression will create new law in the state of Ohio, reining in overreach by the Ohio EPA regarding water quality standards.
