WASHINGTON, D.C. – July 23, 2019 – BakerHostetler has announced that Marc G. Schildkraut has joined the firm as a partner in its antitrust and competition practice. Based in Washington, D.C., Schildkraut was previously with Cooley LLP.

Schildkraut has more than two decades of private practice experience and served as an assistant director with the Federal Trade Commission’s (FTC) Bureau of Competition. He has helped clients obtain antitrust clearance on some of the country’s highest-profile M&A transactions in a variety of industries, including energy, retail, aviation, technology, telecommunications, and food and beverage. In his role as lead attorney, he has always been successful in obtaining merger clearances for his clients.

A sampling of the significant M&A matters that Schildkraut was involved with include Chevron’s merger with Texaco, Exxon’s merger with Mobil, BP’s merger with Amoco, Boeing’s merger with McDonnell Douglas, PepsiCo’s merger with Quaker, Albertson’s merger with American Stores, joint ventures between Texaco and Shell, Intel’s acquisition of Chips and Technology and Nestle’s acquisition of Alpo.

Schildkraut successfully fought several attempts by the FTC to prevent major acquisitions. But he has also obtained an injunction in private litigation that unraveled a consummated merger that would have adversely impacted his client.

While assistant director at the FTC, Schildkraut led investigations into hundreds of merger transactions, as well as several federal court injunction actions and administrative litigations. He also led an investigation involving anticompetition charges against a leading technology company.

“Marc brings to BakerHostetler immense talent in antitrust investigations and related litigation,” said W. Ray Whitman, chair of the firm’s national Litigation group. “Our Litigation group has more than 370 lawyers from coast to coast, and Marc adds further depth to our well-regarded group that includes former prosecutors, veteran civil trial lawyers and former enforcement officials from various agencies.”

“Marc is a solid addition to our robust, problem-solving national antitrust team,” said Carl W. Hittinger, BakerHostetler's antitrust and competition practice team leader. “His decades of experience, with and before the government antitrust agencies through monumental M&A matters, shows that Marc has done and seen it all. The antitrust deal and compliance background he brings is a tremendous asset to our firm and of special benefit to our clients.”

“I am thrilled to be joining the well-respected antitrust team at BakerHostetler, comprising many attorneys whom I have either worked alongside or across the table from,” said Schildkraut. “The environment for M&A remains robust, and many proposed tie-ups receive intense scrutiny. High-level counseling should remain a priority for companies considering such deals. I look forward to providing this service to clients on all their transactions.”

Schildkraut received his B.A., magna cum laude, from Columbia College of Columbia University, and his J.D. from Columbia University School of Law.

BakerHostetler’s antitrust and competition practice team consists of more than 40 lawyers across the country and is recognized for thoughtful, practical strategies focused on positioning clients for success in the most crucial matters. Additionally, BakerHostetler is one of the few firms in the country that successfully defends large-scale class action antitrust matters, including taking those cases to trial and through appeal.
