Overview

Wade Mitchell concentrates his practice in the areas of toxic tort, commercial litigation and products liability related to construction or personal injury. He has defended several major chemical manufacturers against claims of injury from chlorinated solvents, fiberglass resins and asbestos, requiring in-depth analysis and application of a wide range of epidemiological and medical literature. With insightful and developed understanding of the litigation process, Wade is practical and recognizes which issues raised during a lawsuit have a place and which are extraneous.

  • Coordinates national asbestos litigation for a leading manufacturer of automotive braking systems and chassis components. Supervises and addresses discovery responses, as well as prepares and defends all corporate witnesses during litigation. Has been involved in more than 1,500 cases nationwide on behalf of the client.
  • Represented a manufacturer in a fatal industrial accident. Coordinated the defense of a personal injury claim with Occupational Safety and Health Administration and Ohio Industrial Commission issues and reached a successful settlement on behalf of the client.
  • Represented a construction surety company in a problematic public contract. The general contract had been terminated, thus requiring the surety to step in to complete the project on time. Addressed subcontractor claims, a balk charge and other issues associated with the termination of the general contract.

Experience

  • Represented an automotive components manufacturer sued for theft of trade secrets. Dealt with temporary restraining order and preliminary injunction issues, eventually obtaining dismissal of the case on behalf of the client.
  • Represented several former manufacturers of asbestos products in more than 3,000 cases brought by merchant seamen claiming injuries from asbestos exposure aboard ship.
  • Represented a major national construction firm in more than 1,000 cases throughout Ohio.
  • Represented the inventor of a fast-switching, liquid crystal light shutter at trial, resulting in a $5 million verdict in favor of the client against a Fortune 500 company.
