James W. Seegers

James Seegers, who is Board Certified in Labor and Employment Law by the Florida Bar Association, advises and represents private- and public-sector management clients in connection with employment and labor law matters. He has litigated issues related to discrimination, retaliation, whistleblowers, employment contracts, non-compete agreements and constitutional rights in federal and state courts in Alabama, Arkansas, Florida, Georgia, Mississippi, North Carolina, South Carolina and Texas. Mr. Seegers has represented employers in a number of industries in multi- and single-state class and collective actions involving, among other things, Title VII, Section 1981 and the FLSA.

Mr. Seegers has represented employers in such matters as union organizing campaigns, contract negotiations, unfair labor practice charges and grievance arbitrations. He has also handled matters involving the National Labor Relations Board, the Florida Public Employee Relations Commission, the Department of Labor, the Occupational Safety and Health Administration, the Department of Justice, the Equal Employment Opportunity Commission, the Florida Commission on Human Relations, the Orlando Commission on Human Relations and the Florida Division of Administrative Hearings.

Mr. Seegers has significant experience assisting employers in defending against OSHA citations and whistleblower claims and in providing OSHA compliance advice. This includes assisting employers in catastrophic workplace events resulting in serious employee injury and/or death, as well as addressing associated civil actions and related labor issues for transportation, hospitality, health and education-related businesses.

Mr. Seegers has represented employers in union organizing campaigns, contract negotiations and grievance arbitrations involving disciplinary actions and contract interpretation. Some of Mr. Seegers’ more notable client work includes:

  • Successfully defended a nationwide trucking company against claims of racial discrimination and harassment in a class action.
  • Successfully represented a major airport in defeating a union organizing attempt.
  • Successfully represented a large transportation company in defeating a union organizing attempt.
  • Successfully represented a large nationwide hospitality company in an OSHA matter resulting in dismissal of several willful violations.
  • Successfully represented a large nationwide power company in a breach of fiduciary duty action against the President of a subsidiary.

Mr. Seegers has appeared on national and local television discussing employment law issues. Mr. Seegers is also a frequent lecturer on a variety of topics of interest to employers, including OSHA, the NLRA, Florida Ethics Law and best employment practices.

Mr. Seegers is active in the community, serving as the President of the Rotary Club of Celebration, serving on the Leadership Committee of Troop 125 of the Boy Scouts of America and volunteering at Give Kids the World.

Mr. Seegers is a member of The Florida Bar and the Orange County and Osceola County Bar Associations.
