Keith Murphy’s practice is concentrated on corporate and financial restructuring, insolvency, bankruptcy litigation and debtors’ and creditors’ rights, with a particular emphasis on representing trustees in brokerage house liquidation proceedings commenced by the Securities Investor Protection Corporation (SIPC), and receivers in securities and investment fraud proceedings initiated by the Securities and Exchange Commission (SEC) and the Commodities Futures Trading Commission (CFTC).
Mr. Murphy is counsel to the SIPA Trustee for the liquidation of Bernard L. Madoff Investment Securities LLC and the consolidated estate of Bernard L. Madoff in connection with Madoff’s Ponzi scheme. He works with the litigation and investigation teams and has brought numerous avoidance actions seeking to recover assets from feeder funds, banks, insiders, entities and individuals for the benefit of defrauded customers and the estate.
Mr. Murphy’s other current and past clients include debtors-in-possession, secured and unsecured creditors, trustees, receivers, airline lessors, equipment lessors, parties to executory contracts and a variety of other clients with respect to the enforcement of debtors’ and creditors’ rights across numerous industries, including manufacturing, retail, steel, airlines, healthcare and financial services sectors.
Prior to joining Baker Hostetler, Mr. Murphy worked in the bankruptcy department at Kaye Scholer LLP, where his practice focused on representing receivers in SEC and CFTC proceedings and chapter 11 debtors and creditors in a variety of insolvency proceedings. After earning his Juris Doctor degree, Mr. Murphy clerked for the Honorable Stephen D. Gerling, Chief Judge for the United States Bankruptcy Court, Northern District of New York. Following his clerkship, Mr. Murphy worked as an associate at Winick & Rich, P.C. in the bankruptcy department.
