Caroline M. Landt

Caroline Landt practices employment law, advising and defending for-profit and not-for-profit employers in employment law issues. She has litigated matters related to discrimination, sexual harassment, labor-management relations, minimum wage/overtime compensation, covenants not to compete and executive employment contracts.

Ms. Landt has successfully represented clients before the Eleventh Circuit, the Florida Supreme Court, the National Labor Relations Board, the U.S. Equal Employment Opportunity Commission and the Florida Commission of Human Relations.

Ms. Landt focuses her practice on all aspects of the Fair Labor Standards Act including audits of employee classifications and pay practices, compliance guidance, training, and defense against Department of Labor investigations and FSLA litigation.

Ms. Landt has successfully prosecuted non-compete violations and trade-secret misappropriations in both federal and state courts. Additionally, Ms. Landt assists clients with creating protective measures through non-compete, non-solicitation and non-disclosure agreements.

Some of Ms. Landt’s more notable client work includes:

  • Won appeal before National Labor Relations Board after prevailing before an Administrative Law Judge. NLRB Chairman issued opinion finding employee’s ringing of a break bell to create a work stoppage was not protected by the National Labor Relations Act.
  • Prosecuted former employee and new employer for tortious interference, breach of non-compete agreement, breach of duty of loyalty and improper disclosure of confidential information resulting in settlement wherein new employer paid significant damages and both former employee and new employer agreed to considerable business restrictions.
  • Obtained multiple preliminary injunctions without notice from separate judges on separate claims enjoining former executives from employment with the client’s competitors.
  • Defended Orange County, Florida in a Title VII claim, and settled for a nominal amount. When the Plaintiff refused to honor the settlement agreement, Orange County filed a breach of agreement claim against the Plaintiff seeking to enforce the oral settlement agreement. The Eleventh Circuit upheld the District Court’s judgment at trial enforcing the settlement, resulting in the Plaintiff having to pay damages to Orange County, Florida and losing all settlement payments.
  • Authored a “Friend of the Court” brief filed with the Florida Supreme Court in support of a tax exemption for religious publications based on the First Amendment. The exemption was preserved and Ms. Landt served on a panel for Discussion with Arguing Attorneys moderated by Honorable Major B. Harding as part of the Florida Bar’s Practicing Before the Supreme Court series that studied this high profile case.
