Overview

Brandon Crossland is a commercial litigator with in-depth experience handling complex contractual matters and business disputes. Over the past few years, he has concentrated on breach of contract, corporate and shareholder disputes, timeshare and hospitality litigation for one of the leading timeshare companies in the world, and debt collection, foreclosure and restructuring matters on behalf of financial institutions. He has also been involved in federal bankruptcy litigation and issues relating to music copyright and intellectual property.  

Brandon is thoughtful, aggressive and committed to resolving issues for clients, whether as part of pre-suit negotiations or at any point throughout the litigation process. His experience allows him to understand each client's business and legal needs, and enables him to be a trusted counselor who can provide advice related to every aspect of an issue.

  • Lead trial counsel in an adversary proceeding in the United States Bankruptcy Court for the Middle District of Florida representing a business management firm and its client in a six-day trial regarding the rights of the firm’s clients relating to various streams of income, as well as administration rights over certain music copyrights. Member of the team that obtained a final judgment in favor of the firm’s clients as to each and every claim at the close of the plaintiff’s case when the court granted the defendants’ motion for judgment on partial findings. The victory allowed the clients to maintain control over their interest in a valuable music copyright portfolio, and received confirmation that the firm’s clients were entitled to all of the streams of income that had been received over the past 20 years.

  • Successfully defended a local company against claims of tortious interference and violations of Florida’s Uniform Trade Secrets Act by assisting the client in resolving the dispute at mediation for a cost-effective and extremely positive result.

  • Obtained a final judgment in favor of a firm client giving them the right to immediately collect on a multimillion-dollar judgment, and thwarted the improper efforts of a judgment debtor to avoid the client’s collection efforts. Acted as lead trial counsel in a multi-day trial in the United States District Court for the Northern District of Florida.

  • Represented one of the largest global hospitality and vacation holiday corporations in critical litigation regarding whether the client's newly developed, trust-based timeshare program would be permitted to vote its interests in timeshare associations in a Central Florida resort. Ramifications of the litigation were crucial to continued success of the client's trust-based timeshare ownership program. The court entered judgment in favor of the client, permitting the client's trust program to vote its interests in the associations, and placing receivership over the associations to ensure that voting interests were properly managed, and to ensure sustained fiscal vitality for the associations after severe mismanagement of the resort. Substantial attorney's fees were awarded in favor of the client for its efforts in pursuing the litigation.

  • Successfully resolved a multimillion-dollar shareholder dispute prior to the clients being forced to expend significant legal fees in a lengthy lawsuit by negotiating an amicable resolution, despite the existence of difficult contractual terms in a poorly drafted shareholder agreement. Ultimately, assisted the clients in drafting a new shareholder agreement, which excluded the disputing shareholder, and gave the clients their business back.
