The Federal Trade Commission recently announced a proposal to ban noncompete clauses in employment for workers at all levels.
Quoted for a Jan. 13, 2023, Agenda article titled “Proposed Ban on Noncompetes Could Sway Executive Comp,” Partner Joyce Ackerbaum Cox said eliminating such clauses for “lower level workers” may be a reasonable approach to giving such employees space to maneuver in the job market, but exceptions should be made for certain employees and circumstances.
“I just think not having any carveouts — whether it be for trade secrets, or C-suite executives or certain management-type people — would be a problem,” she told Agenda.
