Partner Teresa Goody Guillén was quoted in a Feb. 22, 2023, Thomson Reuters article titled “Testing Howey: With Congress Stalled, the SEC Stakes its Expanding Crypto Enforcement On a Nearly Eight-Decade-Old Test.”
According to the article, the Securities and Exchange Commission is “ramping up its enforcement campaign against the cryptocurrency industry” on the basis of the SEC’s view that much of what the crypto industry offers fits the definition of securities.
There have been a number of recent high-profile cases involving crypto defendants settling with the SEC for tens of millions of dollars, something that is not too surprising because it is so expensive to litigate, Goody Guillén told Thomson Reuters.
