Todd Lebowitz Explains Why Lack of Joint Liability Rulemaking Not a Big Problem

Although the National Labor Relations Board (NLRB) has proposed a new rule governing when entities are jointly liable for wage and hour violations, the U.S. Department of Labor (DOL) has yet to announce plans to offer rulemaking or guidance on the topic. That’s according to a Law360 Employment Authority article titled “DOL Quiet On Joint Employment As NLRB Takes On Issue,” published Sept. 9, 2022. In an interview for the article, Partner Todd Lebowitz said the lack of formal rulemaking is not a major problem. “We have years and decades of guidance from the courts. It would be a lot better if we had clear regulations from the DOL, but the lack of regulations doesn’t necessarily change anything.”
