Titled “Two Circuits, One Unambiguous Clause: Applying the Same Cost-Deduction Language Across Jurisdictions,” the article delves into how two federal circuit courts interpreted identical lease language and how this is an example of what can happen if parties specify what is a “marketable” product in a lease.
