The Economic Aid to Hard-Hit Small Businesses, Nonprofits and Venues Act (Economic Aid Act), enacted into law on December 27, 2020, provides additional, much-needed relief to businesses and families economically impacted by the COVID-19 pandemic. In particular, the Economic Aid Act rebooted the Paycheck Protection Program (PPP) with $284.5 billion of funding for first-time borrowers and businesses looking to take second PPP forgivable loans. Along with the new funding, “PPP 2.0” includes amended rules for first-time borrowers, new rules for “Second Draw PPP Loans,” and new terms and processes for loan forgiveness for all borrowers.

BakerHostetler and Protiviti Forensic hosted a complimentary CLE program on the revived PPP. Our expert panel explained what borrowers need to know to comply with the new PPP rules and other pertinent economic stimulus provisions included under the Economic Aid Act, such as the additional funding for the Economic Injury Disaster Loans grant program; discussed the criminal and civil enforcement risks borrowers face if they do not follow the rules; and provided practical measures borrowers can take now to mitigate risk.
