Bethany Lukitsch Says Failure to Stay Litigation During Appeals Is Costly

Coinbase Global Inc. has asked the U.S. Supreme Court to resolve a split among circuit courts over whether litigation should be stayed automatically when parties appeal the denial of a motion to compel arbitration.

“The cost of proceeding with discovery, expert work and class certification pending an appeal can be staggering,” Partner Bethany Lukitsch told Law360 for an Oct. 6, 2022, article titled “Coinbase Wants Justices To Settle Split on Arbitration Stays.”

According to the article, Lukitsch said the importance of the Coinbase case is particularly pronounced in consumer class actions, many of which are filed in California and New York, “where circuit precedent does not guarantee a stay pending appeal.”
