The article “Justice Department Lawsuit Could Become One of the ‘Major Cases’ in Antitrust Litigation” discusses how the Justice Department blocked the merger of U.S. Sugar and Imperial Sugar, alleging that the merger would violate Section 7 of the Clayton Act.
“This case may be one of the major cases going forward on how you define relevant market even further,” Hittinger told the publication. He added, “If the government is perceived as being aggressive in blocking mergers in different industries, there will be some analysis made in terms of future deals and mergers, as to whether or not people want to take on that battle with the government.”
