Partner Carl Hittinger was quoted in a March 23, 2023, Law360 article titled “Juries Not Buying DOJ Antitrust Labor Push As Losses Mount.” The article concerns a string of Department of Justice losses in trials involving wage-fixing and no-poach charges.
Historically, charges of this type were pursued as civil liability, according to the article. In 2020, the DOJ began to make such charges criminal. This change is significant. “Criminal means people go to jail and bad things happen,” Hittinger told Law360. “If it was a civil prosecution... the jury might feel different about it.”
