On July 8, 2022, Partner Carl Hittinger was quoted in a Law360 analysis titled “2 Mistrials, 1 Acquittal & A DOJ Listening Problem.” The article was about the July 7 Denver federal court acquittal – after two hung juries – of five current and former executives of Pilgrim’s Price Corp. and Claxton Poultry Farms, who had been accused of bid rigging. Hittinger said the DOJ doesn’t have unlimited resources and should pick and choose carefully the cases it prosecutes. Further, if companies facing DOJ antitrust charges choose to go to trial, sometimes the defendants will win, he said.
