On August 11, 2022, Partner Daniel Kaufman was quoted in “FTC Begins Privacy, Security Rulemaking over GOP Rebuke” in Law360. Over the objections of its two Republican commissioners, the FTC this week gave notice of proposed rulemaking. It is seeking public input as part of its plan to craft new rules that would set limits on companies’ use and sharing of consumer data; it also plans to crack down on lax data security. Kaufman says the rulemaking will take many years. If completed, he says, new rules “would have an enormous impact on how companies do business.” However, he adds, any broad rule would likely encounter legal challenges questioning whether the FTC has authority to set such rules.
