Overview

David Mancino is a U.S. patent attorney with more than 25 years of experience representing clients in all areas of patent law and leads the Cincinnati Office Intellectual Property Group. David focuses on patent litigation, prosecution, opinions and licensing. His litigation experience includes over 100 litigations in venues across the U.S. District Court, the Patent Trial and Appeal Board (PTAB), the International Trade Commission (ITC) and the Court of Appeals for the Federal Circuit (CAFC). He has experience litigating and prosecuting numerous technologies, including electronics, software, artificial intelligence, semiconductor design, electronic circuits, information technologies, lasers/optics, medical devices, automotive components and jet engine technologies.

David has been named “Lawyer of the Year” for Cincinnati patent litigation by The Best Lawyers in America® in both 2013 and 2022, listed as a “Best Lawyer” since 2010 and ranked in Chambers USA since 2012. He co-authored Patent Local Rules for the Southern District of Ohio and was a member of the committee advocating for the implementation of the rules set forth in the document.

  • Served as technical lead during trial in a patent infringement action before the International Trade Commission, during which BakerHostetler's client ultimately prevailed. Prepared all technical issues and handled the technical witnesses throughout the ITC investigation involving three patents related to computer forensic devices. 
  • In a patent litigation in the Northern District of Illinois involving database query technologies, successfully briefed and argued that an asserted American Express patent was invalid as failing to meet the "written description" requirement under U.S. patent law.
  • In a patent litigation trial in the Eastern District of Texas involving DVD recorder products of a Japanese consumer electronics corporation, handled all technical issues and technical witnesses during the litigation and trial. Following trial, the parties reached a settlement highly favorable to BakerHostetler's client.

Experience

  • Prepared and prosecuted a family of patents for a high-speed digital printing company, patents that have been successfully licensed to most of the digital printing industry, and the company has also survived several patent litigations without any successful challenge to the validity and scope of the patents. 
  • Negotiated the IP and data licensing agreements in a joint venture between a European market research company and a major U.S. retail corporation in 2003. The agreements lasted throughout the duration of the companies' highly successful joint venture due to Dave's understanding of the issues and technologies involved.
