Overview

David Aronoff is an established trial lawyer who focuses his practice on complex business litigation. Drawing from over two decades of experience, he has represented public and private companies at trial in federal and state courts throughout the country, before arbitration panels, and in investigations involving the Securities and Exchange Commission (SEC), Department of Justice (DOJ), Federal Trade Commission (FTC), Financial Industry Regulatory Authority (FINRA), Consumer Product Safety Commission (CPSC), Office of the Comptroller of the Currency (OCC), FED, and states Attorneys General. Notably, David has deep experience handling securities class actions and consumer class actions involving advertising claims.

  • Defended major national retailer in a widely publicized case in which the federal court for the Northern District of California denied class certification of a false advertising class action, finding that the proposed class representative had been solicited by the plaintiff’s counsel and was not an adequate class representative.
  • Represented a national bank in connection with the foreclosures of millions of dollars of commercial properties located throughout the United States. Representation resulted in the appointment of receivers, the issuance of injunctions, and the liquidation of real and personal property.
  • Represented national electronics retailer in high-stakes competitor litigation resulting in a significant published opinion in the area of the “litigation privilege.” Served as lead counsel in defense of counterclaims brought by a competitor. The company prevailed on summary adjudication, obtaining dismissal of claims for intentional interference through application of the California “litigation privilege.”

Experience

  • Represented a bank in litigation against multiple borrowers on credit lines arising out of the development of luxury residential real estate in Hawaii. The case was tried to a California jury who returned a verdict in favor of the client on claims of breach of contract and fraudulent conveyance. Before the jury returned its verdict on the bank’s claims, sought and obtained a non-suit of the borrowers’ lender liability counterclaims against the bank.
  • Represented a prominent California real estate developer and home builder in an arbitration placed with the American Arbitration Association. The arbitration involved close to one billion dollars in residential and commercial real estate. Obtained several substantial arbitration awards for client.
  • Served as lead counsel to the former ownership of one of the oldest newspapers in the country in litigation and counterclaim against current ownership, resulting in a significant out of court settlement for his client.
  • Represented major national retailers in counseling involving cutting-edge, evolving application of state and federal consumer privacy rights laws. When necessary, litigated issues related to the application of these new laws
