Jason Oliver is a litigation attorney with a focus on complex intellectual property disputes, advising clients on patent, trademark and copyright infringement matters. He plays an instrumental role in all aspects of the representation process, from drafting motions through participation in court hearings.

Jason is innovative in his work, developing the best courses of action to grant clients their desired intellectual property rights, whether through litigation or existing portfolio review and analysis.

Jason is also involved and invested in the startup community, representing and counseling clients in a wide variety of technology verticals. He serves as a member of the firm’s nationwide Emerging Company team.

Trademark Litigation/Enforcement

  • Represented a leading family office and financial adviser entity in connection with the prosecution of a trademark infringement action in the U.S. District Court for the Southern District of New York. Obtained favorable settlement at outset of discovery, which included broad injunctive relief and a portion of attorneys’ fees associated with the action.

Copyright Litigation

  • Represented a foreign emerging technology consulting firm and secure online transaction provider in defense of a copyright infringement action associated with new business ventures in the United States. Efficiently settled the matter for the client in order to eliminate exposure to the threat of infringement. Counseled the same company in connection with the procurement of U.S. intellectual property rights.

Patent Litigation

  • Represented foreign weapons manufacturer in connection with the filing of a petition for inter partes review (IPR) related to competitor’s patents covering a scope for a firearm. Worked with foreign counsel to secure a global settlement agreement ending litigation in multiple jurisdictions.

Trademark Litigation/Enforcement

  • Represented a leading family office and financial adviser entity in connection with the prosecution of a trademark infringement action in the U.S. District Court for the Southern District of New York.   • Represented a provider of a computer-based repository for genealogical research information as a plaintiff in a trademark infringement and unfair competition action filed action in the U.S. District Court for the Southern District of New York. Successfully negotiated name change of defendant entity and obtained injunctive relief through settlement.
  • Represented software company in connection with trademark infringement action over marks for enterprise-grade content deployment solutions. Responsible for settlement of action filed in the U.S. District Court for the Southern District of New York, which provided client with injunctive relief.
  • Represents a global cybersecurity vendor in connection with the defense of a trademark cancellation proceeding in the Trademark Trial and Appeal Board (T.T.A.B.). Also serves as counsel in connection with the prosecution of a related trademark infringement, unfair competition and false advertising action filed in the U.S. District Court for the Eastern District of Pennsylvania.
  • Represented one of New Jersey’s largest Chevrolet dealerships in the U.S. District Court for the District of New Jersey in a trademark and copyright infringement, unfair competition and trade secret misappropriation case. Obtained a speedy preliminary injunction in favor of the client through persuasive brief writing and oral argument.
  • Served as a team member in connection with the global enforcement of a sporting association’s worldwide trademark rights concerning a wide variety of fashion and apparel items.

Copyright Litigation

  • Represented a foreign emerging technology consulting firm and secure online transaction provider in defense of a copyright infringement action associated with new business ventures in the United States. Efficiently settled the matter for the client in order to eliminate exposure to the threat of infringement. Counseled the same company in connection with the procurement of U.S. intellectual property rights.
  • Represented boutique hotel in a John Doe copyright infringement action filed in the U.S. District Court for the Southern District of New York. Obtained dismissal with prejudice before client was formally named in lawsuit.
  • Represented a foreign online marketplace for mobile applications run on Android operating systems in the defense of a copyright infringement action involving alleged contributory/vicarious liability and filed in the U.S. District Court for the District of Hawaii.

Patent Litigation

  • Represented foreign weapons manufacturer in connection with the filing of a petition for inter partes review (IPR) related to competitor’s patents covering a scope for a firearm. Worked with foreign counsel to secure a global settlement agreement ending litigation in multiple jurisdictions.
  • Represented an RFID tag manufacturer in defense of a patent litigation action brought by a competing company in the Northern District of Texas regarding asset and patient position location systems for use in hospital settings. Settled the complex case in a manner that was cost effective and beneficial to the client.
  • Represented one of the country’s premier novelty device manufacturers as the plaintiff in a patent infringement action in the District of Minnesota concerning stepped sound modules. Obtained a favorable Markman ruling on all claim terms in dispute and settled the matter shortly thereafter.
  • Represented the plaintiff in a patent infringement action concerning age verification systems in the U.S. District Court for the Eastern District of New York. Obtained a favorable Markman ruling on the claim terms in dispute and settled the matter shortly thereafter.
  • Served as counsel for the patent owner in an ANDA litigation relating to Solaraze, which is used to treat actinic keratosis. The litigation was settled when the defendant’s distributor acquired the patent licensee. Fougera Pharms., Inc., and Jagotec AG v. Tolmar, Inc., Civil Action No. 10-02635 (D.N.J. 2012).
