Overview

Jay Krupin is co-leader of BakerHostetler’s National Labor Relations team. He has successfully negotiated more than 350 collective bargaining agreements and has represented companies in more than 100 union elections and campaigns. Jay is a respected practitioner whose advice has been relied upon by government agencies dealing with labor and employment issues, and he has testified before the U.S. Congress on labor legislation, as well as before the National Labor Relations Board on rulemaking proposals.

Jay represents national and international businesses, counseling on appropriate employment procedures and establishing effective practices for dealing with labor relations issues. He is well-versed in management-union issues, employment discrimination matters and wage-hour practices, and has been engaged to represent corporations in virtually every aspect of labor and employment law.

Since 2010, Human Resource Executive Magazine has listed Jay on Lawdragon’s Top 100 list of “The Nation’s Most Powerful Employment Attorneys.” A frequent speaker and writer on topics related to his fields of practice, Jay has been quoted in and has authored articles in a number of national publications and has been a featured speaker and commentator on programs addressing such issues. 

Jay is also the Washington, D.C. Labor and Employment Leader.

  • Struck a landmark collective bargaining agreement with a hotel labor union in a marathon bargaining session on behalf of new ownership. Without a restructured agreement between management and the union, the 90-year-old property would have been destined to close. The agreement provided ongoing jobs for employees and addressed economic issues at stake between management and the union through effective negotiations.
  • Represented a food service industry distributor in one of the largest labor relations campaigns undertaken in the United States. Fought a lengthy and involved battle to defeat the union in an election before the National Labor Relations Board (NLRB), which found no merit to charges of unfair labor practices filed by nonunionized client employees.

Experience

  • Representing a manufacturing and distribution client in a petition to the U.S. Supreme Court following negotiations and subsequent job action. Litigating important issues regarding the legitimacy of the NLRB’s decisions on cases during recess appointments and without appropriate membership quorum.
  • Advising an ownership group on comprehensive labor relations strategy following attempts by an influential union to organize the client’s employees through a card check process instead of a standard election. The union attempted to force adoption of the process and place pressure on an investor to terminate the client as owner in order to facilitate unionization, which would decrease property value significantly. The labor relations strategy developed resulted in investors’ voting to unanimously retain the client as hotel owner.
