On July 15, 2022, Of Counsel Mike Semes was quoted in a Law360 analysis, “State And Local Tax Cases To Watch In 2022’s 2nd Half.” Commenting on a case before the Pennsylvania Supreme Court, Semes said Zilka v. Philadelphia could clarify a 2015 U.S. Supreme Court ruling, Comptroller v. Wynne.
The plaintiff, Diane Zilka, claims the city of Philadelphia double-taxed her by refusing to credit her Delaware state income taxes paid against her city tax liabilities. She is challenging a Pennsylvania Commonwealth Court finding that she says misapplies the 2015 decision, which held that Maryland didn’t provide a credit for other state taxes paid against a county tax. She says that under Comptroller v. Wynne, state and local taxes must be considered as one.
