Overview

Scott Holbrook handles his clients’ biggest and most complex cases, both at trial and on appeal. He has substantial experience representing clients in class action, breach of contract, banking, insurance, healthcare and securities litigation matters.

Select Experience

  • Represented a large hospital client in a two-month jury trial against its major market competitor. The trial team obtained an award of more than $10 million in damages and attorneys' fees, in what is believed to be the largest commercial verdict in the county's history and one of the few times in the nation a nonprofit institution has been found liable for a civil RICO violation. The team successfully defended the verdict on appeal.
  • Defended a major financial institution against an Employee Retirement Income Security Act (ERISA) class action in which the company's stock fund lost hundreds of millions of dollars over a two-year period. In a decision receiving national attention because of its major implications for the calculation of damages in ERISA "stock drop" cases, the litigation team obtained a dismissal of the putative class representative's case for lack of standing, which the Sixth Circuit affirmed on appeal.
