Overview

A member of the Tax Group and practicing in the area of employee benefits and executive compensation for more than two decades, Stacy Wilhite handles all areas of employee benefits law, including matters related to qualified and nonqualified retirement plans, cafeteria and health and welfare plans and executive compensation. She assists employers with all facets of employee benefit plan legal compliance, operation and administration, including compliance issues involving the Internal Revenue Code, Employee Retirement Income Security Act (ERISA), Health Insurance Portability and Accountability Act (HIPAA), the Consolidated Omnibus Budget Reconciliation Act (COBRA) and the Affordable Care Act.

Stacy has extensive experience advising clients regarding employee benefits and executive compensation matters associated with mergers, divestitures and acquisitions. She has assisted clients with U.S. Department of Labor (DOL), Internal Revenue Service (IRS) and Pension Benefit Guaranty Corporation (PBGC) inquiries, investigations and audits, benefits-related regulatory filings and in utilizing the IRS’s Employee Plan Compliance Resolution System (EPCRS) and the DOL’s Delinquent Filer Voluntary Compliance Program (DFVCP) and Voluntary Fiduciary Correction Program (VFCP).

Having spent six years as employee benefits associate counsel for a large not-for-profit health system with locations in 22 states, Stacy shares a deep understanding of clients’ business needs and benefits decisions and administration.
