Overview

Tamara Baggett's litigation practice covers a wide array of industries, including construction, real estate, energy and others. She is skilled at handling all aspects of litigation, including in regards to matters such as brand protection and unfair trade practices, contract disputes, entity breakups and shareholder disputes, fiduciary litigation and tort defense. She also has experience litigating a variety of intellectual property matters, ranging from trade secret claims to licensing disputes.

Having begun her legal career handling matters in the courtroom, Tamara has extensive experience litigating in federal and state courts, and handling arbitrations and actions before regulatory/administrative agencies. Notably, she has experience protecting judgments through the appeals process. Prior to her legal career, Tamara worked in the aerospace industry, providing her with fundamental knowledge of corporate processes and strategies. By combining her legal and business backgrounds, Tamara provides clients with a comprehensive view of their matters and intelligently guides them through the litigation process.

  • Reversed judgment on $8 million jury verdict for MEP contractor.
  • Obtained favorable settlement for telecommunications company in cell tower improvement project dispute after disposing of several fact-intensive equitable claims.
  • Obtained favorable settlements for subcontractors in several cell tower improvement project disputes.
  • Asserted breach of contract and other claims on behalf of client in suit against four defendants in federal court to protect client’s intellectual property and defend client against antitrust and other counterclaims. Prevailed on a motion for partial summary judgment dismissing all of defendants’ counterclaims and awarding client summary judgment on the issue of defendants’ liability for breaching their respective contracts.
  • In matter between a prepared foods company and a food distributor, protected trial court’s denial of motion to compel arbitration on appeal.
  • Represented plaintiff in multimillion-dollar contract dispute, obtaining full recovery of disputed amount, interest and attorneys’ fees, and avoiding protracted litigation of alter ego and other bases of indirect liability. Protected the judgment through the appeal process and recovered full amount from defendant after appeal.
  • Represented EPC contractor in construction arbitration with subcontractor, resulting in multimillion-dollar recovery.
  • Developed internal lien process and procedure for subcontractor for construction projects in multiple states, streamlining lien procedure for multistate operations.
  • Represented client in action to discover identities of online posters, providing client an avenue to protect reputation and business against anonymous individuals. Protected order allowing pre-suit investigation of online posts through appellate process.
  • Counseled reality star client on online defamation matters and anti-SLAPP risks.
  • Obtained DMCA takedown and additional subpoenas to identify online infringers.
  • Obtained removal of negative online posts from third party websites for several clients.
  • Negotiated favorable settlements for Fortune 500 metal processing company in numerous sales agreement disputes in Texas courts and pre-litigation, avoiding protracted litigation.
  • Obtained several summary judgment motions for lenders and loan servicers in cases involving allegations of fraud, trespass to try title and breach of contract.
  • In prosecution of claims against fiduciaries, defeated assertions of contractual bars to obtain favorable arbitration awards and settlements.
  • Obtained favorable settlement for land owner in multimillion-dollar case brought by tenant in hotel construction dispute.
  • Represented client in personal injury case involving a rear-end collision in which jury found no negligence.
  • Directed verdict for defense in a premises liability case in which a worker was injured in a UT Arlington fire.
  • Obtained summary judgment for Fortune 500 metal processing company in wrongful death case, resulting in early resolution prior to multiparty trial.
